1. Introduction & acceptance

These Terms of Service (the “Terms”) form a binding agreement between you and Listofer (“Listofer,” “we,” “us,” or “our”) and govern your access to and use of our websites, applications, and services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

If you are using the Service on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. Accounts

To use most features of the Service you must create an account. You agree to:

• Be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract.
• Provide accurate, current, and complete information and keep it up to date.
• Keep your login credentials confidential and remain responsible for all activity under your account.
• Notify us promptly of any unauthorized use or suspected breach of security.

3. Use of the Service

You may use the Service only in compliance with these Terms and all applicable laws. You agree not to:

• Use the Service in any way that violates eBay’s policies, user agreement, or seller standards.
• List prohibited, counterfeit, infringing, or unlawful items, or post misleading content.
• Reverse engineer, scrape, overload, or interfere with the Service or its infrastructure.
• Attempt to gain unauthorized access to any system, account, or data.

You are solely responsible for the content you create, list, and publish through the Service, and for ensuring it complies with eBay’s rules and applicable law.

4. Subscriptions & billing

The Service is offered on a subscription basis. Unless otherwise stated:

• Plans are billed monthly or annually in advance via Stripe and renew automatically until cancelled.
• Pro, Business, and Enterprise plans include monthly credits for AI-powered features. See listofer.com/pricing for current plan details.
• You can cancel or change plans from the billing portal in your dashboard; cancellation takes effect at the end of the current billing period.
• We do not charge per-sale or commission fees on the items you sell.
• Fees are exclusive of taxes, which you are responsible for where applicable. Except as required by law, payments are non-refundable.

We may change our prices from time to time; any changes will apply to the next billing cycle after reasonable notice.

5. eBay integration

The Service connects to your eBay account through eBay’s official API. By linking your account, you authorize Listofer to access and act on your eBay data and listings on your behalf as necessary to provide the Service.

• You remain the owner of, and fully responsible for, your eBay store, listings, orders, and customer relationships.
• You are responsible for complying with eBay’s policies, fees, and terms at all times.
• eBay is a third party and is not responsible for the Service; eBay’s API availability and rules are outside our control and may change.
• You may revoke our access to your eBay account at any time through eBay or by disconnecting the integration.

6. Intellectual property

The Service, including its software, design, and content (other than your content), is owned by Listofer and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You retain ownership of the content you submit. You grant us a license to host, process, and display that content solely to operate and improve the Service.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated output will be accurate or suitable for your purposes. You are responsible for reviewing all output before use.

8. Limitation of liability

To the maximum extent permitted by law, Listofer and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amounts you paid to us for the Service in the twelve months preceding the event giving rise to the claim.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or for prolonged inactivity. Upon termination, your right to use the Service ends, and we may delete your data in accordance with our retention practices. Provisions that by their nature should survive termination will survive.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms with a new effective date or notifying you in the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
